10.7 Emil Mazzoleni – Il principio di causalità nei nuovi delitti ambientali. Un’analisi giusfilosofica
In 2015 the Italian Goverment proposed a riform of criminal environmental legislation (act 68/2015). This law provoked an increase of legal studies about not only the environmental ethical problems, but also the idea of causality in criminal law. This paper builds on conceptual analysis and data from everyday trials in order to defend the thesis that causality is fundamentally normative, that is, it cannot be reduced to purely descriptive factors. This aim will be specifically achieved through the analysis of philosophical dilemmas in the italian criminal environmental law.
